ADULTERY AND THE NATURALIZATION LAW
Question: Some years ago I applied for naturalization, I am separated from my husband and a neighbor told an investigator I had committed adultery. I denied it, but the naturalization examiner tells me the Naturalization Service will recommend against my naturalization. What should I do?
Answer: If the accusation was unjust, you should insist on continuing with your naturalization procedure with the help of a social agency or a lawyer specializing in the field. Adultery under the Immigration and Naturalization Act prevents a finding of good moral character, but there must be more proof than merely a denunciation. In case you do not wish to proceed with your naturalization at this time, you can apply again five years from the date of the alleged incident. If you have lived an irreproachable life since that time, you should not have any difficulty.
